In Australia, married couples can apply for a dissolution of their marriage following 12 months of separation known as a “divorce”. After a divorce is granted, either party can then remarry. However, the divorce process does not deal with issues relating to children and/or financial matters as these are separate processes. This is different from many other countries like UK or European countries.
Our family law system encourages separated married or de facto couples to make genuine attempts to come to their own agreement about issues arising from separation. Where parties are unable to reach an agreement or negotiations have reached an impasse, lawyers can help by providing opinions about realistic outcomes and help progress the matter in order to provide closure for the parties.
Costs vary from case to case because the simple reason is that every family is different and therefore have different needs. Some cases are more complex than others. The cost of our Initial Consultation is $385 incl. GST and after this first meeting, we will provide an estimate of your future legal fees moving forward depending on your needs. As a social enterprise, we're driven to ensure affordable and accessible legal support. Our focus is always on you maintaining a positive family relationship, whilst also preserving your asset pool. We are accredited with JustFund which is a funding service if you need help paying your invoices before your property settlement.
You can check your eligibility for a grant of legal aid with your local state Legal Aid agency to receive help with your legal fees.
If you are not eligible then you should seek assistance from your local Community Legal Centres which are funded primarily to assist parties who are financially disadvantaged.
It is recommended that all agreements should be recorded in a legal document prepared by a lawyer and properly signed so that it is legally binding on the parties. This means if a party does not comply with the agreement, then the legal enforcement methods can be used to enforce the agreement in future. There are different legal documents available to record a private agreement including court issued “consent orders” or a binding financial agreement depending on the complexity of the agreement.
If you come to your own agreement after separation, then the legal documents can be prepared relatively quickly with lawyers and timing could vary between 6 to 12 weeks depending on cooperation between the parties and the registry processing time for consent orders if applicable. However, if there is no agreement then negotiations can be protracted and in some cases it can take up to 12 months or more for parties to reach a compromise.
